By accessing or using Digital Legacy Guard ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. The Service is provided by SmartKit Labs ("we", "us", "our").
Digital Legacy Guard is a web-based digital organization and planning platform. It helps you record and structure information about your digital life, online accounts, financial accounts, digital assets, subscriptions, legacy decisions, emergency contacts, and family or executor arrangements.
Important: Digital Legacy Guard is not a law firm, financial advisor, investment advisor, tax advisor, or estate-planning professional. The Service does not provide legal, financial, investment, tax, or estate-planning advice. Any output from the Service, including suggestions made by the AI Legacy Assistant, is for informational and organizational purposes only and should not be relied upon as professional advice.
To use the Service you must create an account and maintain access through a valid paid entitlement obtained via Paddle. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. You must provide accurate and complete information when creating your account or updating your profile.
Access to the Service is sold as a paid subscription. The current offer is US$59.90 for the first 2 years of access, followed by US$29.90 per year thereafter, billed automatically until cancelled. Prices are stated in United States dollars and may be subject to applicable taxes.
Payments are processed by Paddle, our payment provider and merchant of record. By completing a purchase, you agree to Paddle's terms and privacy policy. SmartKit Labs does not store your full payment card details.
You retain ownership of any information, notes, or content you enter into the Service ("User Content"). You grant us a limited license to host, store, and process your User Content solely to operate the Service for you.
You agree not to use the Service to store payment card numbers, passwords, PINs, seed phrases, private keys, recovery codes, or other credentials that are intended to grant access to accounts or assets. The Service is designed to record where information is held and who should receive it, not the secrets themselves.
You may not use the Service for any unlawful purpose, to infringe on the rights of others, to distribute harmful code, to attempt to gain unauthorized access to our systems, or to interfere with the Service's operation. We may suspend or terminate access for violations.
You may cancel your subscription at any time. Upon cancellation, your access will continue until the end of your current paid period. We may suspend or terminate your account if you violate these Terms or if required by law. You may request deletion of your account and User Content by contacting us at the address below.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
You are solely responsible for the accuracy, completeness, and legality of your User Content and for any decisions or actions you take based on information stored in or produced by the Service.
To the maximum extent permitted by law, SmartKit Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising from your use of the Service, even if advised of the possibility of such damages. Our total liability for any claim relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the Service or by email. Continued use of the Service after the changes become effective constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the jurisdiction in which Smart Kit Labs is organized, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved in the courts of that jurisdiction.
